Terms and Conditions

§1 General provisions

These Terms and Conditions govern the use of the online store available at https://hellomotoparts24.com, operated by:

The business is entered in the Polish Central Register and Information on Economic Activity (CEIDG). The competent registration authority is the Minister Finansów i Gospodarki (Minister of Finance and Economy of the Republic of Poland).

These Terms and Conditions are permanently available on the website and may be saved and reproduced. Before placing an order, the customer should read these Terms and Conditions.

§2 Definitions

  1. Store / Seller – HelloMotoParts24, JBL KONRAD KRUSZENIUK.
  2. Customer – a natural person, legal person or organisational unit placing an order.
  3. Consumer – a customer within the meaning of the applicable consumer protection provisions.
  4. Entrepreneur with consumer rights – a natural person entering into a contract directly related to their business or professional activity where the contract is not of a professional nature for that person.
  5. Product – an automotive part or accessory offered in the Store.
  6. Order – the customer’s declaration leading to the conclusion of a sales contract.
  7. Sales contract – a distance contract concluded between the customer and the seller.

§3 Subject of the contract

  1. The Store sells new automotive parts and accessories.
  2. Product descriptions, photographs, prices and availability are presented on the relevant product pages.
  3. The seller makes every effort to ensure that the information presented in the Store is accurate and up to date.

§4 Orders and payments

  1. Orders may be placed through the online Store, by e-mail at info@hellomotoparts24.com or by telephone at +48 600 078 003.
  2. The prices displayed in the Store include the applicable VAT unless clearly stated otherwise.
  3. Available payment methods may include, among others, ING Pay, PayPal, cash on delivery and bank transfer. The payment methods displayed during checkout are the methods applicable to the order.
  4. The sales contract is concluded when the order is accepted for processing in accordance with the applicable law.

§5 Delivery

  1. Delivery is carried out by courier companies and other delivery operators offered in the Store.
  2. Delivery costs are calculated individually according to weight, dimensions and delivery method. The final delivery cost is shown during checkout before the order is placed.
  3. Collection in person is possible by prior arrangement.
  4. The customer should inspect the shipment on receipt and report visible transport damage without undue delay.

§6 Changes and cancellation

  1. An order may be changed or cancelled before dispatch.
  2. After dispatch, cancellation is possible only in accordance with the applicable return and withdrawal rules.

§7 Complaints

The seller is responsible towards consumers and entrepreneurs with consumer rights for the conformity of the goods with the contract in accordance with the applicable mandatory provisions.

The consumer rights described in this section also apply to a natural person entering into a contract directly related to their business or professional activity where, in particular in view of the subject of that activity, the contract is not of a professional nature for that person (“entrepreneur with consumer rights”).

A complaint may be submitted by a consumer as well as by an entrepreneur with consumer rights.

Complaints may be sent by e-mail to info@hellomotoparts24.com.

Where possible, the complaint should include information facilitating its handling, in particular the order number, product details, a description of the defect or non-conformity, the date on which it was identified and the remedy requested by the customer.

The absence of any of the above information does not result in the loss of the customer’s statutory complaint rights.

The seller handles complaints from consumers and entrepreneurs with consumer rights within the period provided by law, as a rule within 14 days of receiving the complaint.

If the complaint is justified, the customer is entitled to the remedies provided by the applicable law, including – where the relevant legal conditions are met – repair, replacement, price reduction or termination of the contract and refund of the purchase price.

The above provisions do not limit any mandatory statutory rights of consumers or entrepreneurs with consumer rights.

§8 Warranty

  1. Some products may be covered by a manufacturer’s or seller’s warranty.
  2. Where stated in the offer, exercising warranty rights may require professional installation and appropriate proof.

§9 Right of withdrawal

  1. A consumer and an entrepreneur with consumer rights, as defined in §2 of these Terms and Conditions, have 14 days to withdraw from a distance contract without giving any reason.
  2. The withdrawal statement may be sent to info@hellomotoparts24.com.
  3. The goods must be returned within the statutory period. The direct cost of returning the goods is borne by the customer to the extent permitted by law.
  4. Statutory exceptions to the right of withdrawal remain applicable.

§10 Personal data

The data controller is JBL KONRAD KRUSZENIUK. Detailed information on the processing of personal data is provided in the Store’s Privacy Policy.

§11 Final provisions

  1. The seller may amend these Terms and Conditions for important reasons, in particular due to changes in law or in the Store’s offer.
  2. In all other matters, mandatory provisions of applicable law shall apply.
